Terms and Conditions

1. THE CONTRACT

The contract for a short-term holiday rental will be between Brian and Diane Potter trading as Sandbeds Holiday Cottages (referred to “us”, “we” or “our”) and the person making the booking and all members of the holiday party (referred to as “you” or “your” in the following booking terms and conditions. All our properties are located in England and we and you agree that English Law will govern our contract with you. If any individual term or clause stated in these terms and conditions are held to be invalid, impermissible or unenforceable by law, the remaining terms shall be unaffected and shall remain valid.

The contract will not come into force until a deposit has been received which is referred to in Section Two. The contract will be subject to the following terms and conditions and must be complied with. The person making the booking must be at least 21 years of age at the time of booking and prior to their arrival must provide us with a complete list of names, contact detail and ages.

2. DEPOSIT AND PAYMENT

Your booking may be placed over the telephone, by email or directly on our online reservation system. If you wish to book via telephone or email, we will enter your details onto our online reservation system, this system will automatically generate an enquiry/booking to the email address you have provided. However, this does not mean that your booking is confirmed or that the contract between us and you is yet in force.

Your booking will only be confirmed and our contract will only come into force once we have received cleared funds of payment of a deposit equal to a minimum of one hundred and fifty pounds (£150) for Coomb View and The Coach House at Arnside. The larger property of Sandbeds would require a two-hundred-and-fifty-pound deposit (£250) or twenty-five per cent (25%) of the total booking cost whichever is the greater.

The DEPOSIT must be paid within THREE (3) days of the booking being placed.
The BALANCE OF PAYMENT for the rental will be due for payment forty-two (42) days prior to your arrival. The secure payment section of our online reservation system accepts most major credit, debit cards or bank transfer.

If for any reason you are unable to make the final payment on your due date, forty-two (42) days before arrival, we will regard this non-payment as your intention to cancel the booking. If your booking is less than forty-two (42) days, then your booking will only be confirmed once we have received full cleared payment. Once full payment has been received our contract will come into force.

No entry into any of our properties will be allowed without full cleared payment beforehand.

3. CANCELLATIONS

Cancellations must be notified in writing (by email) and received by us. Once received we will confirm receipt of your cancellation and process your request.
If you cancel prior to the due date of your final payment, cancellations are subject to a fifty (50%) per cent cancellation fee of the deposit paid.

If you cancel your booking between 41(41) days and (30) days before your arrival date you will lose fifty (50%) per cent of your full booking cost.

If you cancel your booking less than thirty (30) days, then we will not refund your payment as we will have incurred costs and we are unlikely to re-let our accommodation at such short notice.

For this reason, we strongly recommend you take out Travel Insurance for Holidays in the United Kingdom which covers you for booking cancellations and that the Travel Insurance you choose also provides you with peace of mind if you need to cancel your booking at last minute due to unforeseen circumstances. If you choose not to cover your booking with Travel Insurance, then you accept responsibility for any loss incurred due to your cancellation.

4. CANCELLATIONS BY US FOR REASONS BEYOND OUR CONTROL (“FORCE MAJEURE”)

We will not be deemed to be in breach of contract or liable to you if non access or delayed access to any of our properties is caused by circumstances beyond our reasonable control. If access or use of our properties is prevented by fire, flood, dangerous weather conditions, epidemics, pandemics, destruction/damage, internet or other communications failure, blocked roads, war/terrorism, nuclear/radioactive disaster affecting us or our property. These are described as “Force Majeure”.

If we, for any reason which is beyond our control and are forced to cancel your booking our liability will be limited to the cost of your stay with us or if we  are forced to terminate your booking early due to the events described as above “Force Majeure” which affects us and our properties we will refund you based on the remaining amount of your stay. This will be the full extent of our liability and no compensation, expenses or travel and accommodation costs will be payable to you.

5. PERIOD AND TERMS OF HIRE

The period of hire is from the commencement date of your holiday to the day of departure set in your booking unless expressly agreed by us in writing.

The check in time on the date of your commencement of holiday is from 4pm and your check out time on the day of departure is before 10 am. These times will be clearly outlined on your booking. Late vacation of the property may result in you being charged an additional day’s rental.

The contract between us and you are to use our property for the sole purpose of a holiday let and you as the holidaymaker have to right to occupy our property from 4pm on day of commencement to 10am on the day of your departure. You may not sub-let our property.

The contract to stay in our properties for your holiday does not create a Landlord and Tenant agreement.

We do not offer a daily housekeeping or meal service and your booking includes a onetime bed linen and towel set up.

6. NUMBER OF GUESTS

Under no circumstances must you exceed the maximum number of guests in our properties. Coomb View has a maximum of four (4) people plus one (1) infant, Sandbeds has a maximum of ten (10) people plus two (2) infants and the Coach House has a maximum of five (5) people plus one (1) infant.

7. SECURITY DEPOSIT

A security deposit of 100 pounds (£100) for Coomb View and The Coach House at Arnside and our property of Sandbeds a security deposit of two hundred and fifty pounds (£250) will be required. This payment will be required at the time of your booking. This security deposit may not be applied towards the rental of our properties and will be fully refundable within 72 hours after your day of departure provided our properties have been vacated in the same state of repair and in a clean and tidy condition at the end of your booking and no damage has occurred within our property or its contents including bed linen and towels. 

8. CARE OF OUR PROPERTIES

Please ensure that our property is securely locked when not occupied by you and all keys are put back in the key safe after securing our property on your departure day.

On departure day we respectfully ask you place all rubbish and recycling in the outside bin store and all dishes are placed in the dishwasher and cleaned on a hot wash.

You are responsible for our property during your holiday booking, and you are expected to take care of its furniture, pictures, fixtures, fittings and effects inside and outside of our property.

You must not use our property for any dangerous, offensive, illegal or immoral activities or carry out any act that may a nuisance or annoyance to us as the owners or any of our neighbouring properties.

We have a non-smoking policy which is strictly forbidden in any of our properties.
We do not accept bookings from Hen or Stag Parties for any of our properties. 

9. DAMAGES AND BREAKAGES

We will not charge for the accidental breakage of an odd glass or crockery item. 
You are legally bound to reimburse us for any replacement, repairs or extra cleaning costs arising from neglect or wilful damage on demand within 7 days of notification reason and will be automatically deducted from your security deposit should this problem occur. Your liability is not limited to the value of your security deposit. 

10. PETS

We do not allow pets in any of our properties under any circumstances. This policy has been adopted to assist us in ensuring the highest level of cleanliness, for the protection of our guests who had pet allergies and the unpleasantness of pet odour.

11. WIFI AND INTERNET

We provide free Wi-Fi and internet for your use during your stay and is provided for your reasonable use. You agree to using this service within the law and we are not liable for possible slow connection or interruption or failure of this service which is beyond our control.

12. RIGHT OF ENTRY

We shall be allowed the right of entry to our properties at reasonable times for the purpose of inspection or we, our contractors, cleaners need to carry out repairs or maintenance.

13. DRONES, NIGHT LANTERNS AND FIREWORKS

The use of drones, night lanterns and fireworks are strictly forbidden. Night Lanterns and Fireworks are a hazard and can cause death or injury to livestock.

14. CARE OF YOUR PROPERTY

Your vehicles and contents, any personal property or valuables you choose to bring with you are left entirely at your own risk.

You must also take the necessary steps to safeguard yourselves and your personal property. We shall not be liable to you or a member of your party for loss or damage to your personal property.

16. FEEDBACK

Every effort has been made to ensure you have a fantastic stay with us. If you experience any issue during your stay, it is essential that you contact us immediately to give us the opportunity to resolve the issue. We truly value your custom and want you to enjoy your holiday with us. Should any problem arise, we will do our very best to resolve the problem.
